MICHIGAN DRAFT MINUTES TOWNSHIP BOARD JANUARY 19, 2010 COMMUNITY SERVICE BUILDING EASTPORT, MICHIGAN

Present: Parker, Schultz, Martel, Tomlinson and Windiate Absent: None Others: Todd Millar Audience: +/- 9 1.
Meeting was convened at 7 PM followed by the pledge to the flag.
2. Motion to approve the minutes of December 15, 2009 with one addition was seconded and passed 5-0. In item 8 A. first line, after Township attorney add “regarding pending litigation”.
Motion by Tomlinson to approve the minutes of Closed Session of December 15, 2009 as prepared was seconded and passed 5-0.
Motion by Tomlinson to approve the minutes of January 8, 2010 with two corrections was seconded and passed 5-0.
Change the date to read “January 7, 2010” and in item 2, second line change Martel “was asked” to Martel “volunteered”
3. Correspondence: None received.

4. Agenda Content: Motion by Windiate to add item 8 j. Recommendation to hire Stasevich is seconded and passed 5-0. 5. Citizen Commentary: From the audience, Sheriff Bean read County 911 report. Martel inquired into the number of deer/car accidents. The reply was from 400-500 in the county.
6. Consent Agenda: Motion to approve, minus EMS Report was seconded and passed 5-0. After discussion, motion by Tomlinson to approve the following items be paid from Special Assessment District was seconded and passed 5-0.

7. Informational Items: A. County Planning Commission report. Martel stated that at their meeting they discussed whether or not they should exist. Because it is in the law and not expensive they will stay with it. B. Township Planning Commission report. Tomlinson reported they are redoing the PRD/PUD, will wrap it up next month and hopefully have a Public Hearing in March.
C. Regarding Speed Limit on N.W. Torch Lake Dr. Parker reported that, after traffic studies, the State Police recommended no change be made in the speed limit and it should remain at 55 mph.
 D. Parker, Ditlow and Tomlinson met with Allied EMS in Harbor Springs and asked them to prepare a proposal of costs to operate our EMS department. They were also asked to prepare a proposal to do our billings.
8. A. Motion by Schultz to move to closed session to discuss pending litigation with Township attorney at 7:23 PM was seconded and passed 5-0, roll call vote.
Motion by Martel to return from closed session at 8:04 PM was seconded and passed 5-0, roll call vote.
Motion by Tomlinson to approve the settlement reached at the facilitated mediation held January 14, 2010 was seconded and passed 5-0.
B. Salary Resolutions: It was agreed the Board would freeze any salary raises for the second year in a row.
Motion by Parker to approve salary resolution #10-01 for supervisor to remain at $18,500 for the 2010-2011 budget year, as read, was seconded and passed 5-0 roll call vote. Motion by Tomlinson to approve salary resolution #10-02 for Trustee to remain at $3600 for the 2010-2011 budget year was seconded and passed 5-0 roll call vote.
Motion by Windiate to approve salary resolution #10-03 for Clerk to remain at $18,500 fro the 2010-2011 budget year was seconded and passed 5-0 roll call vote.
Motion by Schultz to approve salary resolution #10-04 for Treasurer to remain at $21,000 for budget year 2010-2011 was seconded and passed 5-0 roll call vote.
These resolutions are subject to approval by the Torch Lake Township electors at the annual meeting March 20, 2010.
C. Regarding the paving of Erickson Road. Torch Lake Township needs to find $27,380 in addition to the $46,000 already in the road Fund to pave Erickson. Motion by Tomlinson that we would indicate to Antrim County Road Commission and Milton Township that we will contribute $73,379.50 as our share of the pavement of Erickson Road to be paid in the 2010-2011 fiscal year as per letter dated 12-31-09 signed by Burt Thompson.
 Discussion that this is an estimate, not a bid, but is probably on the high side.
Motion is seconded and passed 4-1 with Martel casting the nay vote.
D. Please have any items for the Newsletter to Parker by February 1st. E. From Maryanne Jorgensen, her suggestion is to separate into two parcels and reduce the listing prices for the old Township Hall property, as outlined in her meme.
Motion by Schultz to renew Maryanne Jorgensen contract for another 6 months and accept proposal as presented with revised listing price of $126,000 for Township offices and $99,000 for EMS building is seconded and passed 5-0.
Parker will sign the new contract.
F. EMS Medical Insurance for 2010-2011. After discussion, Motion by Parker to adopt Priority Health HAS Plan for the 2010-2011 fiscal year for EMS full time crew as per proposal dated 1-11-2010 is seconded and passed 5-0. G.
Liquor Inspections. After discussion, Motion by Tomlinson to authorize $18 per hour for liquor control enforcement to a qualified person, per Supervisor’s instruction is seconded and passed. 5-0.
H. Planning Consultant Chris Grobbel is offering the same basic contract as before but with a reduced hourly rate of $20/hour.
Martel outlined his concerns in memo dated 1-19-2010, which he handed out and shard with the Board. Tomlinson commented the Planning Commission is happy with him as the Planner and he is doing what he is asked to do.
Motion to approve the proposed contract as submitted by Grobbel dated December 2, 2009 was seconded and passed 3-2 with Martel and Schultz casting the two nay votes.
I. Motion to approve the amended Board Meeting Schedule dated 1-19-2010 is seconded and passed 5-0. J.
Motion by Windiate to recommend we offer employment to Kolleen Stasevich as Recording Secretary for the Planning Commission and ZBA effective immediately is seconded and passed 5-0. 9.
A. Board Commentary: Schultz reminded citizens dog licenses are available trough the end of February. They can pick up applications in the office or on the website. One or 3 year licenses are available.
B. Tomlinson asked about the Barnes Park sign. Jerrold Drenth was glad George called and will speak to the Board of Commissioners.
10. Citizen Commentary: Mr. Knoechel and Mr. Mottern, working on pre-census activities, have discovered there are some missing street signs. Anyone that notices, please call Ed or the Township. EMS might be likely to notice.
 From Ditlow, there will be EMS training at the CSB this Saturday. They need “practice patient” volunteers if anyone is interested.
